Terms and Conditions of Service

Please read carefully before signing the Registration Form.
  1. These terms and conditions shall be incorporated in the contract between "Nannies and Childcare Nanny Agency" (hereinafter referred to as "the agency") and yourself (hereinafter referred to as "the client"). The candidates for employment shall be referred to as "the applicant" and upon employment "the employee".
  2. The signature of the Client Registration form by the client shall be seen as acceptance of these terms and conditions.
  3. All information supplied by the agency must be kept in the strictest confidence and not disclosed to a third party. Should any applicant become employed by a third party through details disclosed by the client or without the agencys knowledge, then the full placement fee will be due immediately from the client.
  4. The agency does not take any responsibility for loss or damage or expense caused by the employee to the client or his/her property or a third party. The agency endeavours to ensure the applicant is suitable for the position by interviewing and checking references. Please note the agency may not have confirmed the background details of any one interviewee for permanent placement and it is therefore imperative the agency is informed of when an applicant is to be employed by you. The agency does not give any warranty concerning the character, ability or health of an applicant. The client is responsible for checking all references and CVs or any other information supplied, being satisfied as to the suitability of the applicant even though The agency will have carried out all these checks. The applicants are not the employees of The agency.
  5. Fees for temporary staff in nurseries will be paid (for the 1st invoice) 7 days after the invoice date and for all other invoices (14 days after the invoice date). Nurseries will be invoiced bimonthly. Temporary staff are not the employees of The agency and Nurseries should make sure that they have adequate insurance to cover temporary employees. The agency assures Nurseries that all temporary staff will have been reference checked, qualifications checked and will hold a clear Enhanced Disclosure. The Disclosure number will be made available to Nurseries, if required.
  6. The placement fee agreed is due 7 or 14 days after invoice. Any unpaid placement fees after the date agreed for commencement of the employment of the applicant shall incur a surcharge of 20% for each week of delayed payment.
  7. If a temporary placement becomes a permanent placement, the full fee will be payable as this constitutes a new contract and if part-time placement becomes full-time within three months of commencement, then the balance of the full placement fee will be payable.
  8. In the event that the employment of the successful applicant is terminated within one month, then a free replacement will be offered only on the basis that the client did not misrepresent the Conditions of Employment and has paid the placement fee. In the event of either our client or applicant withdrawing before the date of commencement of the position and the fee has been paid, then The agency will refill the position to the satisfaction of our client. Only, if we are unable to refill the position, will a refund be due.
  9. Should the nursery decide to offer more work to an employee, even if the offer has not been made directly through the agency, further charges will be made on the temporary scales unless an agreement is made to transfer the candidate from the temporary charges to a permanent fee in full settlement.
  10. For permanent vacancies, we will look at your specific requirements and will advise potential employees of the full details of your vacancy. The candidates are closely matched for their suitability to the vacancy and after short listing applicants who have registered an interest in the position we will provide you with a full curriculum vitae, profile of their personality and copies of their references for you to look through at your convenience. We will then arrange interviews at times to suit your timetable.

prices scale of charges

PERMANENT STAFF
The Agency fee is calculated on the commencing annual taxable pay and will be:
Nursery Nurse/ Assistant One week of the annual gross salary
Nursery Senior/ Room Manager One and half week annual gross salary
Deputy/NVQ level 4/Manager One and half week annual gross salary

TEMPORARY STAFF
PLEASE NOTE ** booking is 4 hrs ( half day ) or 4 hrs + will be full day rate.

Nursery Nurse
Per Day- 8 hours = £76
half day rate- 4 hours = £38
Additional hours after the 8 will be charged at £9.50 per hour

Nursery Assistant
per day (8 hours) = £68
half day rate (4 hours) = £34
additional hours after the 8 will be charged at £8.50 per hour

Probationary Candidate
On the first day per day ( 8 hours ) = £66
half day rate (4 hours) = £40
Additional hours after the 8 will be charged at £9 per hour
Weekend work will be charged at time and a half and bank holidays are charged at double time.

Please note that due to our fees being calculated as the minimal and to include wages our payment terms are strictly 14 days after invoices are issued. All fees are to Tax at the prevailing rate.

refunds in respect of permanent staff wage

A refund of the engagement fee will be made to the employer on the following basis provided that the fee has been paid within 14 days of invoice and the contract is terminated within eight weeks.
  • An employee who fails to take up his/her duties and no suitable replacement is found: A FULL REFUND WILL BE MADE excluding a £50+ TAX administration fee.
  • The Client cancels the agreement of employment after a firm offer has been made but before the employee takes up the permanent position: an administration fee of £50 + TAX will be charged.
  • The employment is terminated within the four week probationary period by the employer or employee: 75% of the original fee will be refunded excluding an administration fee of £50 + TAX. Alternatively, a replacement employee will be found for 25% of the original fee.
  • A permanent employee leaves the employment within eight weeks of the agreed commencing date: 50% of the original fee will be refunded excluding an administration fee of £50 + TAX Alternatively, a replacement employee will be found for 50% of the original fee.

The terms and conditions of business set out below are between NANNIES AND CHILDCARE (The Agency) and the prospective employer (The Client) and are to be accepted by The Client on engagement of an applicant introduced by The Agency.

The Client agrees to notify The Agency immediately an engagement is accepted and to pay the fee of the Agency within fourteen days of invoice. The Agency fee is for the engagement of one employee and subsequent employees will be charged at the full fee.

In the event of The Client cancelling the agreement of employment after requesting The Agency to arrange the employment of a Temporary Employee but before the employee has taken up the engagement, the Agency fee will still be payable in full to offset the costs of organising the cover.

In the event of The Client cancelling the agreement of permanent employment after a firm offer has been made, but before the employee has taken up the engagement, then a charge of £50 will be made.

An invoice will be calculated by The Agency as set out in the Scale of Engagement fees and is payable by the Client on the acceptance and not the commencement of employment.

On permanent invoices, if the relevant employment is terminated within eight weeks, the fee or portion of will be refunded to The Client according to the Agency scale given, providing that The Client notifies The Agency within two working days of the employee leaving the employment and that the full fee has been paid by the Client to the Agency within fourteen days of the invoice date.
